Delaware has no state sales tax, so the 15% cannabis excise tax is the only tax consumers pay at the register. This makes Delaware one of the lowest total-tax states for cannabis. Revenue is directed to a Cannabis Revenue Fund covering regulation, public health programs, substance abuse treatment, and reinvestment in communities impacted by prior enforcement.

HB 1 — Delaware Marijuana Control Act

Signed April 2023 by Governor Carney after multiple veto threats. Legalized possession and use of up to 1 ounce of cannabis for adults 21+. Notably, Carney vetoed a previous legalization bill (HB 371) in 2022; the legislature overrode political opposition to pass HB 1.

HB 2 — Delaware Marijuana Act (Regulatory Framework)

Del. Code tit. 4, ch. 15

Companion bill to HB 1. Established the Office of the Marijuana Commissioner, created the licensing framework for commercial operations, set the 15% excise tax, and defined social equity provisions. Sales began in late 2024.

SB 17 — Delaware Medical Marijuana Act

Del. Code tit. 16, § 4901A et seq.

Established the medical cannabis program in 2011. Compassion centers serve registered patients with qualifying conditions. The medical program provided the infrastructure that the adult-use market is now building on.

Brand-new market, ground floor opportunity

Delaware's recreational market is one of the newest in the country. HB 1 and HB 2 passed in 2023, and the first adult-use sales began in late 2024. The regulatory framework is still solidifying. For operators, this means both opportunity and uncertainty — rules are being written in real time, and early licensees are shaping the market.

No home grow — consumers must buy from you

Delaware explicitly prohibits home cultivation under current law. Every ounce of cannabis consumed in the state must come through the licensed supply chain. This is a meaningful structural advantage for dispensary operators — there's no legal DIY alternative undercutting retail sales.

Tax advantage over neighbors

At 15% total tax (no sales tax in Delaware), the effective consumer rate is significantly lower than neighboring Pennsylvania, New Jersey, and Maryland. Delaware has long been a tax-advantaged shopping destination, and cannabis is no different. Operators near the state's northern border (Wilmington area) may see cross-border traffic from Philadelphia and South Jersey consumers.

What you can buy and possess

Adults 21+ can purchase and possess up to 1 ounce of cannabis flower. Equivalent limits apply to concentrates and edibles. You'll need a valid government ID for every purchase. Delaware does not allow home cultivation — all cannabis must be purchased from a licensed retailer.

Why prices may surprise you

Delaware has no state sales tax. The only tax on cannabis is the 15% excise tax at the retail level. If you're used to buying in New Jersey (where total tax can exceed 20%) or Pennsylvania (medical-only with higher per-unit costs), Delaware's prices will feel competitive.

Where to consume

Private property with the owner's permission. No public consumption, no use in vehicles, no use on federal property. Landlords can prohibit cannabis in lease agreements. The beach towns along the Delaware coast are popular tourist destinations — but consuming on public beaches is not legal.
