Issue 2 — Adult Use Cannabis Legalization

Ohio Revised Code Chapter 3780

Voters approved Issue 2 in November 2023, legalizing possession and home cultivation for adults 21+. The Division of Cannabis Control began accepting adult-use applications in 2024. Ohio became the 24th state to legalize recreational cannabis.

HB 523 — Ohio Medical Marijuana Control Program

Ohio Revised Code Chapter 3796

Created the medical marijuana program in 2016. Established the framework that the adult-use market is now building on, including cultivator tiers, processor licenses, and dispensary caps.

SB 261 — Implementation Amendments

The legislature's modifications to Issue 2 after passage, adjusting licensing frameworks, setting tax revenue allocation (36% to social equity, 36% to subdivisions hosting operators, 25% to treatment/education), and defining home cultivation rules.

A market still finding its legs

Ohio legalized adult use via Issue 2 in November 2023, making it the largest Midwest market after Illinois. But implementation has been methodical, not fast. The Division of Cannabis Control took months to finalize rules, and the first adult-use dispensary sales didn't begin until mid-2024. Existing medical operators got conversion priority, so the early market is dominated by familiar names.

For new entrants, the window is narrowing but not closed. Ohio is issuing standalone adult-use licenses in phases. The 10% excise rate is lower than most legal states, which should support healthier margins once competition stabilizes. The population base — 11.8 million people with no bordering recreational states except Michigan — gives Ohio real demand upside.

Licensing reality check

The application process is thorough. Financial disclosure, security plans, community impact assessments, and local government approval letters are all required. Budget $100K–$300K for a dispensary buildout depending on location. Columbus, Cleveland, and Cincinnati are the primary target metros, but suburban and mid-size city locations face less competition for zoning approval.

Buying in Ohio

Adults 21+ can purchase up to 2.5 ounces of flower or 15 grams of extract per transaction. Bring a valid government-issued photo ID — no exceptions. Both medical dispensaries that have converted and new standalone adult-use shops are open for business, though inventory and store count are still ramping up across the state.

Home grow rules

You can grow up to 6 plants per person, 12 per household. Plants must be kept in a secure area not visible to the public. This is one of the more generous home grow allowances in the country. Seeds and clones are available at licensed dispensaries.

Public consumption is prohibited. You can't smoke in a car, in a park, or on a sidewalk. Landlords and employers can still ban cannabis use on their property or as a condition of employment. Ohio's DUI law covers cannabis impairment — there's no defined THC threshold, so any detectable impairment can result in an OVI charge.
